Advantages

A second tax file for the same family.

An HUF is taxed independently of its members, so the family gets its own thresholds, its own deductions and a clean home for ancestral assets.

Tax

Reduce your income tax by lakhs.

An HUF gets its own basic exemption limit and slab benefits, effectively a second set of thresholds for the same family, with proper planning.

Wealth

Legacy asset and wealth creation.

Hold and manage ancestral property and family investments collectively, with a framework that also supports succession planning.

What proper planning can do to the tax rate

Scroll to watch the rate come down. With proper planning, tax on family income can fall from 30–35% to 0–5%.

Without an HUF30–35%

Its own exemption limit

Investments in the HUF's name enjoy a separate basic exemption limit, like a resident individual.

Its own deductions

Claim Chapter VI-A deductions such as 80C, 80D and 80TTA (sections 123, 126 and 153 of the Income-tax Act, 2025) in the HUF's own return.

Invest and earn as a family

Run a business, let property, hold fixed deposits, shares and mutual funds, all in the HUF's name.

Built for the long term

A framework for ancestral assets, family investments and succession across generations.

The sections that matter, old Act and new Act

The Income-tax Act, 2025 replaces the 1961 Act from 1 April 2026, with new section numbers and a single “tax year”.

Old: 80CSec. 123

Investments and insurance

Eligible investments, life insurance premia and provident fund contributions, claimed in the HUF's own return.

Old: 80DSec. 126

Health insurance

Health insurance premiums paid for members of the family.

Old: 80TTASec. 153

Savings account interest

Interest earned on savings accounts held in the HUF's name.

Old: 64(2)Sec. 99(2)

Clubbing of income

Income from a member's own property converted into the HUF can be taxed back in that member's hands.

Whether a deduction is available depends on the tax regime your HUF is assessed under, and limits change from year to year. We confirm both before you invest.

A word on clubbing

If a member transfers their own money into the HUF, the income can be clubbed back and taxed in that member's hands. The corpus is better built through ancestral assets, inheritances or gifts, with proper advice. We plan around this from day one.

Daughters are coparceners by birth

Since the Hindu Succession (Amendment) Act, 2005, a daughter is a coparcener in her own right, exactly like a son, and marriage does not change that.

A woman can be the Karta

Courts recognise that a senior female coparcener can act as Karta, so an eldest daughter can step in when there is no senior male member available.

Your own HUF, alongside your father's

A married son can remain a coparcener in his father's HUF while running a separate HUF with his wife and children, each with its own PAN and tax file.

Frequently Asked Questions (FAQs) – Everything you need to know

What is a Hindu Undivided Family (HUF)?

An HUF is a distinct family entity recognised under Indian law, rooted in the Hindu tradition of a joint family holding property together. It's made up of all persons lineally descended from a common ancestor, plus their spouses.

Importantly, it's also treated as a separate "person" for income tax. It can have its own PAN, bank account, assets, investments, income and income-tax return, separate from the individual PAN and tax affairs of its members

Who can form an HUF in India?

Hindus, Jains, Buddhists and Sikhs can form an HuF family as governed by Hindu law. For income-tax purposes, HUF is recognised as a separate “person” for taxation.

How is an HUF created — do I need to register it?

An HUF isn't registered like a company; it comes into existence by operation of law, typically the moment a person marries and starts a family. So when a person in Kandivali, Mumbai gets married, an HUF can exist automatically.

To make it function — hold assets and file taxes — you formalise it with an HUF deed, a PAN, and a bank account, but the entity itself needs no registration.

What are the 3 practical steps to set up a working HUF and get its PAN?

First, an HUF deed naming the Karta and members and declaring the initial corpus. Deed has to be comprehensive one involving various scenarios of management, protection from mismanagement, accounts, succession including minors etc.

Second, apply for the HUF's PAN — the application goes with the Karta's documents and a notarised affidavit giving the family's details.

Third, open a bank account in the HUF's name.

Once a Karta has these three in place, the HUF can hold assets, invest and file returns.

Is HUF a separate legal entity like a Private Limited Company?

Not exactly. An HUF is a separate taxable person for income-tax purposes, but it is not a company incorporated under the Companies Act. It does not have shareholders or directors in the way a Private Limited Company does.

The family is represented and managed by the Karta, while the other eligible family members have rights according to the applicable Hindu-law framework.

Who is the Karta of an HUF?

The Karta is the head and manager of the HUF — the person who runs its affairs, operates its accounts and acts for the family. Traditionally the seniormost male member used to be the karta. Following the 2005 reform and later court rulings, a senior female coparcener, such as the eldest female member of the family, can act as Karta in the absence of a senior male.

Can a woman be the Karta of an HUF?

Yes, this is now judicially recognised. Since daughters became coparceners in 2005, courts have held that a senior female coparcener can act as Karta. So if a family in Borivali, Mumbai has no senior male member willing or available, the eldest daughter can step into the Karta's role and manage the HUF's affairs.

What is the difference between a coparcener and a member of an HUF?

Every coparcener is a member, but not every member is a coparcener. Coparceners are the lineal descendants — sons and daughters — who acquire a right in the family property by birth and can demand a partition. Members include others like a wife who married into the family, who share in the benefits but don't have that birthright to demand partition.

Only a co-parcener can be a Karta.

Can a daughter be a coparcener even after she marries?

Yes. Since the Hindu Succession (Amendment) Act, 2005, a daughter is a coparcener in her own right, by birth, exactly like a son — and marriage does not change that. So a daughter remains a coparcener in her father's HUF after her wedding, while also becoming a member of the HUF she marries into. The Supreme Court confirmed this birthright applies regardless of when the father passed away.

What are the main income tax benefits of an HUF? Can tax rates be reduced from 30-35% to 0-5%?

The core benefit is a separate tax file. An HUF is taxed independently of its members, so it gets its own basic exemption limit and its own slab benefits — effectively a second set of thresholds for the same family. It can also claim deductions under sections like 80C and 80D in its own right, which opens up genuine, legitimate tax planning. With proper planning, tax rates can be reduced from 30-35% to 0-5%.

So the Agarwal family in Borivali, Mumbai can opt to purchase a joint property through the HUF, where it's taxed in a separate file rather than piled onto Mr. Agarwal's personal returns at a higher slab.

What deductions can an HUF claim?

An HUF can claim many of the same Chapter VI-A deductions available to individuals — for example section 80C (eligible investments and insurance), 80D (health insurance premiums for members), and 80TTA (savings account interest). These are claimed in the HUF's own return, separately from what the Karta or members claim personally, which is what multiplies the family's overall benefit.

I want to transfer my own money into my HUF to save tax. Is that allowed?

You can but the clubbing provisions apply. So it may not make sense for members of HuF to transfer their own property to their HuF.

The income from those funds can be clubbed back and taxed in that member's own hands. So a member gifting his own savings into his HUF won't neatly shift the tax; the corpus is better built through ancestral assets, inheritances or gifts, with proper advice.

Can an HUF run a business or invest in shares and property?

Yes. An HUF can carry on a business, own and let out property, hold fixed deposits, and invest in shares and mutual funds — all in its own name, with income taxed in its separate file. What an HUF cannot earn is salary, since it isn't an individual. Many Hindu families use the HUF precisely to hold ancestral property or family investments cleanly.

Can an HUF have a demat or investment account?

Yes, an HUF can hold investments in its own name subject to the applicable account-opening and investment requirements.

This can be relevant where family assets or investments are intended to be held by the HUF rather than individually by the members.

Can an HUF be used for family wealth management?

Yes. An HUF can provide a framework for holding and managing qualifying family assets and investments collectively.

Its usefulness is not limited to tax. Depending on the family's circumstances, it can also be relevant to asset ownership, succession planning, family investments and management of ancestral wealth.

My father runs our family HUF. Can I start my own HUF too?

Yes — and this is a common question. A person can be a member of his father's HUF and, once married, be the Karta of his own HUF at the same time. So a married son can remain a coparcener in his father's HUF while running a separate HUF with his own wife and children. The two are distinct entities, with distinct PANs and distinct tax files.

Is forming an HUF worth it for my family?

That's exactly the honest assessment our team gives before you set one up — no point in a structure you won't use.

Can an HUF be dissolved or closed?

An HUF is not “closed” in exactly the same manner as a company.

If the family has undergone a complete partition or the HUF otherwise ceases to have relevant property/income, the appropriate legal and income-tax documentation and PAN/return implications should be addressed.
