Income tax returns, explained simply

What you are filing, which law applies this year, and what happens if the due date is missed.

An income tax return (ITR) is your annual statement of income, deductions, taxes paid and assets to the Income Tax Department. Filing is a legal obligation under Section 139 of the Income-tax Act, 1961 for AY 2026-27, and under Section 263 of the Income-tax Act, 2025 from Tax Year 2026-27 onwards. It is required whenever income crosses the basic exemption limit, and in other cases too, such as holding foreign assets or wanting to claim a refund, even when all tax has been deducted at source.

Once filed, the return is processed and an intimation under Section 143(1) confirms no demand, a refund or a demand. Missing or inconsistent information leads to a defective return notice under Section 139(9), which must be cured within the time allowed, usually 15 days.

Original return

Filed by the due date. Preserves carry-forward of losses and every option the law gives you.

Belated return

Filed after the due date, with a late fee of up to ₹5,000 (₹1,000 if income is up to ₹5 lakh), interest on unpaid tax, and most losses lapse.

Until 31 December of the assessment year

Revised return

Corrects an omission or a wrong statement in an original or belated return. A fee applies after nine months.

Up to 12 months after the year ends

Updated return (ITR-U)

Discloses missed or under-reported income with additional tax of 25% to 70%, depending on the delay.

Within 48 months of the assessment year

Which ITR form applies to you?

Pick what describes your income. The matching forms light up. A wrong form is the most common cause of a defective return notice, so this is settled first.

ITR-1Sahaj

Resident individuals with income up to ₹50 lakh from salary or pension, one house property, interest and other sources, and long-term gains under Section 112A up to ₹1.25 lakh.

ITR-2

Individuals and HUFs without business income who have capital gains, more than one house property, foreign assets or income, unlisted shares, a directorship, or are NRIs.

ITR-3

Individuals and HUFs with income from a business or profession, including partners' remuneration, F&O and intraday trading.

ITR-4Sugam

Resident individuals, HUFs and firms (other than LLPs) on presumptive taxation under Sections 44AD, 44ADA or 44AE, with total income up to ₹50 lakh.

ITR-5

Partnership firms, LLPs, AOPs, BOIs, estates, business trusts and investment funds.

ITR-6

Companies, other than those claiming exemption for income from property held for charitable or religious purposes.

ITR-7

Trusts, institutions, political parties, research associations and universities filing under Section 139(4A) to 139(4F).

ITR-U

The updated return, filed alongside any of the above to report missed income and pay the additional tax.

How we file your income tax return

Scroll through the process and watch a specimen acknowledgement come together, from a blank checklist to an e-verified, processed return.

Questionnaire and documents

A short questionnaire maps every head of income so nothing is left out. You get a checklist tailored to your profile and share documents securely.

  • Form 16 / 16A, salary slips, rent and investment proofs
  • Broker and mutual fund statements, property deeds
  • Foreign bank, share and property details for NRIs and residents with overseas assets

ITR form and tax regime

We fix your residential status, choose the correct ITR form and compare the old and new tax regimes on your actual numbers, filing Form 10-IEA where a business owner opts out of the new regime.

Reconciliation

Income and credits are matched line by line with AIS, TIS, Form 26AS, GST returns, bank statements and capital gains reports. Mismatches are resolved, or reported through AIS feedback, before filing.

Computation and tax optimisation

Deductions, exemptions, set-off and carry-forward of losses, DTAA relief and foreign tax credit through Form 67 are applied to arrive at the lowest lawful tax or the highest refund.

Review and tax payment

You receive a plain-language computation to approve. Any balance is paid as self-assessment tax and the challan is linked to the return so it is never missed or paid twice.

Filing on the income tax portal

The return is filed with every applicable schedule, from capital gains and house property to Schedules FA, FSI and TR for foreign assets and income. Tax audit, MAT and transfer pricing forms are filed first where required.

e-Verification

We complete e-verification by Aadhaar OTP, net banking, EVC or a registered digital signature. A return not verified within 30 days is treated as filed on the date of verification, which can make it belated.

Tracking to closure

We track processing, review the Section 143(1) intimation against the return, follow up the refund and respond to any defective return notice or adjustment, with rectification under Section 154 where needed.

Belated, revised and updated returns

Correcting a filed return, or disclosing missed income through ITR-U at the lowest additional tax.

Specimen only. All personal details removed.

Frequently Asked Questions (FAQs) – Everything you need to know

Who is required to file an income tax return in India?

You must file if your gross total income exceeds the basic exemption limit, but filing is also required in several other cases — holding foreign assets, spending large sums on travel or electricity, high bank deposits, or wanting to claim a refund. Importantly, filing under Section 139 is a legal obligation even when all your tax has already been deducted at source.

What documents do I need to file my income tax return?

You'll typically need your PAN, Aadhaar, Form 16 (for salary), Form 26AS and the Annual Information Statement, bank details, and proof of any deductions or investments claimed. If you have capital gains, business income, foreign assets, or rental income, supporting statements for each are needed. Having these ready up front is what keeps filing accurate and fast.

Which ITR form should I file?

The right form depends on your income sources, residency, number of house properties, and whether you have business income. Individuals generally use ITR-1, ITR-2, ITR-3, or ITR-4; ITR-5 applies to partnership firms and LLPs; ITR-6 to companies; and ITR-7 to non-profit organisations. Choosing the correct form is essential to avoid a defective-return notice and to get refunds processed quickly.

What are the income tax return due dates for AY 2026-27?

For AY 2026-27, the due date is 31 July 2026 for most individuals (ITR-1/ITR-2, non-audit) and 31 August 2026 for non-audit ITR-3/ITR-4 cases. Audit cases are due 31 October 2026 and transfer-pricing cases 30 November 2026. A belated return can be filed up to 31 December 2026

Does Entrecap help decide which ITR form I should file?

Yes. Entrecap reviews your sources of income, residential status, capital gains, business or professional income, investments and other relevant information before determining the appropriate ITR form. This is important because choosing the wrong ITR can result in incomplete reporting or a defective return.

Does Entrecap reconcile TDS before filing my Income Tax Return?

Yes. As part of the ITR filing process, Entrecap reviews available TDS and TCS information and reconciles it with your Form 16, Form 16A, Form 26AS, AIS and other supporting documents. This helps identify missing TDS credits, incorrect reporting and tax credits that may otherwise be overlooked.

Can Entrecap help me claim a refund of excess TDS or advance tax?

Yes. If the tax deducted or paid during the year is higher than your final tax liability, the excess can generally be claimed as a refund through the ITR. Entrecap reconciles TDS, TCS, advance tax and self-assessment tax before finalising the return so that eligible tax credits are not missed.

I have foreign shares, a foreign bank account or an overseas property. Do I need to disclose them in my ITR?

A resident taxpayer with foreign assets or foreign-source income will need to provide details in Schedule FA and, where applicable, Schedule FSI and Schedule TR. The Income Tax Department specifically advises taxpayers with foreign assets to use an ITR containing the required foreign-asset schedules rather than ITR-1 or ITR-4. If I have a foreign bank account or overseas investment but did not earn any income from it, do I still need to report it?

A foreign asset may need to be disclosed even where it did not generate income during the year. Schedule FA is intended to capture specified foreign assets and related information, and its applicability depends on your residential status and the nature of the asset. Simply

Will Entrecap help me to claim Income tax credit for foreign taxes deducted from my income?

Yes, Entrecap’s income tax Team has expertise and required software to file Form 67 (income tax Act 1961) or Form 44 (Income tax Act 2025) provide the required tax deduction proofs are submitted by you.

As a Singapore NRI, can I claim 100% exemption on capital gains even after TDS has been deducted?

Yes. Under Article 13 of the India–Singapore DTAA, capital gains on mutual fund units and shares are generally taxable only in Singapore — and since Singapore doesn't tax such gains, the effective liability can be nil. If the AMC has already deducted TDS, you claim a full refund by filing your Indian ITR and disclosing the treaty exemption, supported by your Tax Residency Certificate and Form 10F.

I forgot to claim TDS in last year's ITR. Can I claim that old TDS in this year's return?

No — TDS must be claimed in the return for the year the income relates to, not carried into a later year's ITR. If you're still within the time limit, file a revised return under Section 139(5) for that year to claim the missed credit. If that window has closed, a rectification or condonation request may be the route. We can review which option applies to your case.

My salary is ₹40,000 a month and my employer says 10% TDS will be deducted. Can I avoid it by investing in shares, FDs, or bonds?

If TDS@10% is being deducted, the person paying to you is considering it as professional rather than salary. If there is no other major income, you can get back the TDS deducted as refund after filing income tax returns.

While filing a belated ITR, I accidentally paid twice and got two challans, but didn't add either to my return. How do I fix this?

You add one challan to your ITR by filing a revised return and entering that challan's details under the self-assessment tax schedule, so it's set off against your liability. The second, duplicate challan can be claimed as a refund — either through the return itself or via a refund/re-adjustment request. Getting the challan mapping right matters, so it's worth having it reviewed.

Why is it important to check Form 26AS (Form 168 under the new Income Tax Act 2025) and AIS before filing an ITR?

Form 26AS /Form 168 and the Annual Information Statement (AIS) contain important information about TDS, TCS and various reported financial transactions. Comparing these records with your actual income and documents can identify missing TDS credits, incorrect reporting or income that needs to be disclosed. Entrecap recommends reconciling these records before finalising the ITR rather than relying only on Form 16 or other individual documents.

Does Entrecap assist with belated and revised returns?

Yes. If you've missed the due date, we can file a belated return; if you've spotted an error or a missed credit in a return already filed, we can prepare a revised return. We advise on which route applies to your case and on the late fees or interest involved before proceeding.

I received a defective return notice under Section 139(9). What does it mean?

It means the return you filed was incomplete or didn't meet requirements — a mismatch, a missing schedule, or the wrong form. The jurisdictional officer issues a defective-return notice, and you're given a window to correct and resubmit. Left unattended, the return can be treated as not filed, so these notices should be addressed promptly.

What is an intimation under Section 143(1)?

It's the income tax department's automated summary assessment of the return you filed. After processing, an intimation under Section 143(1) is issued, which may show no demand, a refund due to you, or a tax demand payable. It's not a scrutiny notice — but the figures should be checked against your own return to confirm they match.

Does Entrecap take care of digital signature registration and e-verification?

Yes. We register your digital signature on the income tax portal where required and complete the e-verification of every return we file. Since an unverified return is treated as not filed, we make sure this final step is closed out — a small detail that often decides whether a refund moves smoothly.
